Vaginal Mesh Lawsuit

If you have suffered as a result of using a vaginal mesh patch, you may be eligible to file a vaginal mesh lawsuit.

Vaginal mesh patches are used to strengthen a weak pelvic area which is a common issue for women that have given birth. The mesh is used to repair a bladder or other pelvic organ prolapse (POP) and to correct stress urinary incontinence (SUI). POP occurs when the structures that support the pelvic organs becomes so weak or stretched that the organs drop from their normal position and bulge into the vagina. Surgery to repair POP is done either through the abdomen or through the vagina. To reinforce the repair, the surgeon may use stitches or a transvaginal mesh patch to reinforce the repair. However, using vaginal mesh may be a dangerous treatment option. If you have suffered serious complications, you may wish to file a vaginal mesh lawsuit.

Vaginal Mesh Lawsuit Injuries and the FDA

The U.S. Food and Drug Administration (FDA) has investigated the vaginal mesh patches for several years and have found a large number of post-surgical complication and injuries caused by the vaginal mesh patches. In 2008, the FDA first alerted the public to vaginal mesh problems by releasing a safety communication regarding the complications associated with the placement of vaginal mesh to treat POP and SUI. There had been over 1000 reports of injuries linked to the transvaginal mesh patch. These injuries may be cause to file a vaginal mesh lawsuit.

Injuries that have been reported to the FDA by women that had undergone pelvic organ prolapsed repair surgery which used transvaginal mesh include:

  • Mesh erosion in the vaginal tissues
  • Infection
  • Bleeding
  • Pain during sex
  • Urinary problems
  • Discomfort
  • Vaginal scarring
  • Bowel, bladder and blood vessel perforation

Many women that have had complications due to a vaginal mesh patch have suffered a loss in their quality of life. Those women may file a vaginal mesh lawsuit seeking compensation for medical bills, pain and suffering, plus other damages.

In a 2008 FDA Public Health Notification, the number of complaints reported to the FDA for transvaginal patches used to repair POP and SUI from 2005 – 2007 was over 1000. From January 01, 2008 through December 31, 2010, the FDA received an additional 2874 complaints of complications from use of the vaginal mesh.

On July 13, 2011, the FDA announced in a press release that women that had their POP treated with transvaginal mesh may have a greater risk for complications then patients that used other surgical treatments. Women that have filed a vaginal mesh lawsuit have listed damages such as pain, bladder control problems and significant pain during intercourse. If you have experienced injuries like this, you should file a vaginal mesh lawsuit.

The FDA continues to monitor the safety and effectiveness of vaginal mesh patches now being marketed. If you have had problems with a vaginal mesh patch, report all details to the FDA including manufacturer, type of surgery and the complications suffered. Also be certain to contact a vaginal mesh lawsuit expert attorney in order to recover your costs and receive compensation for your injuries.

Vaginal Mesh Lawsuit And Warnings From The AUGS

The American College of Obstetricians and Gynecologists (ACOG) and the American Urogynecologic Society (AUGS) have also issued a warning regarding the use of transvaginal mesh. The two organizations have asked doctors to limit their use of vaginal mesh and to use the following guidelines:

  • In most cases, POP can be treated successfully without using vaginal mesh.
  • Choose to use vaginal mesh only after carefully weighing the risks and benefits of such surgery. Also consider using non-surgical alternatives.
  • Vaginal mesh is a permanent implant that may make future surgical repair impossible.
  • Using a vaginal mesh may put the patient at risk for requiring additional surgery.
  • If complications arise that may require removal of the vaginal mesh, it may involve many surgeries as well as significantly impair the patient’s quality of life.
  • Complete removal of vaginal mesh may not be possible and removing may not remove complications including pain.
